Google Inc and its affiliates (“Google”) have worked in collaboration with Yola to provide GBBO related tools and services posted at www.GBBO.co.uk] (the “GBBO Site”). We hope you enjoy using them. These terms and conditions are a contract between you and Google and apply to your use of the GBBO Site. They do not apply to your use of any services offered by Yola or any other services provided by partners of Google.
a. set up a website for the use of your business;
b. associate that website with a website address (“domain name”) for free;
c. if you opt in as part of the sign-up process, have that website automatically added to Google Places (as a business listing in Google Maps).
4. In each case, your use of services provided by Yola and other partners will be solely governed by the terms and conditions of use of Yola and other partners, and are set out here for ease of reference. Google is not responsible for providing these services to you, and you will need to check in each case that you are happy with the service and the terms and conditions of service of Yola and other partners before using those services.
a. To create a website through GBBO, you will need to click on ‘create a website now’ and follow the sign up process.
b. You will receive a free domain, website and hosting from Yola for the period of 12 months. Yola may also offer you paid alternatives to the free service.
c. After 12 months, Yola will offer you the ability to enter into a further contract for the services (subject to Yola continuing to provide the services beyond the initial 12 months and Yola’s terms and conditions). After 12 months, you may be able to transfer your domain away from the Yola service.
d. Your agreement with Yola for the services they will provide is bound by their terms and conditions which can be found here: http://www.yola.com/terms
e. You may also have the option to use services provided by Google. The use of those services will be governed by Google’s terms and conditions, which can be found here http://www.google.com/accounts/TOS
f. You may also have the option to use services provided by other partners. The use of those services will be governed by the partner’s applicable terms and conditions
a. You agree not to:
i. Use the web site creation service or domain name registration service for any purpose other than to promote your business;
ii. Ask for more than one free domain name through the GBBO Site;
iii. Knowingly permit anyone to ask for a second domain name to promote the same business;
v. Use your free domain name for any other purpose than to promote your business;
vi. Sell your free domain name or the website created through the GBBO service for money or money’s worth, except in the context of selling your business as a going concern.
vii. Use any services provided by Yola, Google or any other partner in breach of any of the terms and conditions for the use of those services.
viii. The services and offers you receive through GBBO are not for resale and may not be sold or transferred unless the terms and conditions applicable to that service or offer expressly permit sale or transfer.
b. You understand that these terms and conditions may also apply to the services offered by Yola and other partners, where they are incorporated into their terms and conditions.
a. Any data including personal data which: i) you enter into a website run by Google (including www.gbbo.co.uk) will be held by Google subject to Google’s privacy policy (available here: http://ww.google.com/intl/en_GB/privacypolicy.html); and
ii) you enter into a website run by Yola (including www.yola.com/gbbo) will be held by Yola subject to Yola’s privacy policy (available here http://www.yola.com/privacy).
b. Yola and Google may share this data with each other and trusted third parties involved in [GBBO] in order to provide the services offered under GBBO (including the site you create and the domain name you acquire).
c. Google, Yola and other trusted partners may, if you have given your consent in the sign up process, contact you to help you benefit from the service and provide information about other products and services that may be of interest to you.
d. When you request a free domain name, Yola is obliged to provide registrant details to Nominet a body which administers .co.uk and some other UK domains. Nominet will make those details available through a publicly accessible record called a “WHOIS” record, which you can find here: http://www.nominet.org.uk/.
e. This website is a cooperative effort between Google and Yola. This website uses Google Analytics, a web analytics service provided by Google. Google Analytics uses “cookies”, which are text files placed on your computer, to help the website analyze how users use the Getting British Business Online site. The information generated by the cookie about your use of the website (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google will use this anonymous user behaviour information for the purpose of evaluating your use of the website, compiling reports on website activity for website operators and providing other services relating to website activity and internet usage. Google may also transfer this information to third parties where required to do so by law, to Yola or where such third parties process the information on Google's behalf. This means that Yola will be able to view anonymous user behaviour on this site. Google will not associate your IP address with any other data held by Google. You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of this website. By using this website, you consent to the processing of data about you by Google in the manner and for the purposes set out above.
a. Google, Yola and other partners of GBBO reserve the right, at their sole discretion, to change, modify, add, or delete portions of these terms at any time without further notice. If this happens, the new terms will be posted on the GBBO Site. Your continued use of the site you have created via GBBO, or the GBBO Site after any such changes constitutes your acceptance of the new terms.
b. Google, Yola, and other partners of GBBO may change the GBBO Site and the services offered through it from time to time without liability to you. Google does not accept responsibility for or endorse any third party services offered through the GBBO Site.
a. If you use the GBBO Site or any of the services offered through the GBBO Site in contravention of these terms, or of any other terms referred to in these terms, or if you use them against the spirit of the GBBO campaign, the services you are being provided may be withdrawn from you.
b. Google, Yola and partners may end or suspend GBBO or the GBBO Site at any time at their sole discretion without any liability to you. This will not affect the existence of your site.
If any provision of the terms is found to be unenforceable, this will not affect the validity and enforceability of the remaining provisions.
This agreement is governed by English law and you agree that the English courts will have exclusive jurisdiction over any dispute (contractual or non-contractual) concerning these terms except that either party may apply to any court for an injunction or other relief to protect its intellectual property rights.
